Terms and Conditions of Sale.
1. Purpose
These Terms of Service (“Terms”) govern the contractual relationship between Xanocom (for Rovelia.io), registered with the Paris Trade and Companies Register under number 899 485 726, with its registered office at 128 rue de la Boétie, 75008 Paris, France (here in after the “Publisher”), and any individual of legal age, subscribing to the private community service offered by Xanocom (here in after the “Client”).
Any person subscribing to the Service must be an individual who has reached the age of majority (at least 18 years old), hereinafter "the Customer". Any subscription taken out by a minor is strictly prohibited.
Any order placed on the website constitutes full and unreserved acceptance of these Terms and Conditions of Sale.
2. Service Description
The Service consists of access to a private literary and cultural exchange community hosted on the Discord platform.
Access is strictly personal, non-transferable and reserved for the Customer.
3. Pricing
Prices are expressed in euros, inclusive of all taxes. Under the French micro-enterprise regime, VAT is not applicable (Article 293B of the French General Tax Code). The applicable price is that displayed on the subscription page (https://rovelia.io/fr/romance-book-club) at the time of the order. An order confirmation specifying the amount, the subscription plan and the date is sent to the Customer by email immediately after payment. The Publisher reserves the right to amend its prices at any time, without retroactive effect on current subscriptions.
Please note that as an international customer, prices are displayed in euros or us dollars. You are responsible for any currency conversion fees charged by your bank or payment provider.
4. Payment
Payment is due immediately upon subscription. Payment is made exclusively by credit or debit card via the secure Stripe platform, or via Amazon Pay. Any payment failure or incident will result in immediate suspension of access to the Service.
5. Access to the Service
Access to the Service is granted immediately upon confirmation of payment. The Customer receives by email all information necessary to join the private Discord community. Access is provided within a maximum period of 24 hours following payment confirmation.
6. Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the legal withdrawal period, nor to digital content provided immediately after purchase where the consumer has expressly waived this right.
By confirming payment, the Customer acknowledges and accepts that access to the Service is immediate and that they expressly waive their right of withdrawal.
Please note that as this Service is governed by French law, the standard 14-day cooling-off period under EU consumer law does not apply once access has been granted and the Customer has expressly consented to immediate delivery.
7. Subscription Term and Cancellation
The subscription is taken out on a monthly basis and is automatically renewed by tacit agreement.
The Customer may cancel their subscription at any time, no later than 48 hours before the renewal date, via the "Cancel my subscription" feature accessible on the website.
Cancellation takes effect at the end of the current subscription period. A confirmation email is sent to the Customer specifying the effective end date of the contract.
8. Community Code of Conduct
Access to the Community is subject to compliance with the following rules: hateful, discriminatory, defamatory, sexist, racist or unlawful statements are prohibited; harassment, spam, incitement to violence and disruptive behaviour are prohibited; respect for other members and the purpose of the Service is required.
Any breach may result in the immediate suspension or deletion of access. In the event of permanent exclusion for a serious and proven breach of this code of conduct, no refund will be granted for the current period, except where required by mandatory legal provisions. The Publisher has sole discretion in assessing the seriousness of any breach.
9. Liability
The Publisher undertakes to implement the necessary means to ensure the accessibility of the Service. However, the Publisher cannot be held liable for interruptions related to third-party platforms (in particular the Discord community), technical failures beyond its control, or cases of force majeure.
The Publisher's liability is limited solely to direct, certain and proven damages suffered by the Customer, to the exclusion of any indirect or consequential loss.
10. Mediation and Dispute Resolution
In case of dispute, the Client must first contact the Publisher through the contact form.
If no amicable agreement is reached, the Client may use the European Online Dispute Resolution platform (ODR) free of charge:
https://ec.europa.eu/consumers/odr
In the absence of an amicable resolution, the dispute will be brought before the competent courts of Paris, France, subject to any mandatory legal provisions applicable to the Customer as a consumer.
11. Governing Law
Please note that even if you are based in the United States or any other country outside France, these Terms and Conditions of Sale are governed exclusively by French law. By placing an order, you acknowledge and accept that French law applies to your subscription and use of the Service.
In the event of a dispute and after an attempt at amicable resolution, exclusive jurisdiction is attributed to the courts of Paris, France, subject to any mandatory legal provisions applicable to consumers.
For any complaint, the Customer may contact the Publisher via the contact form available on the Website or at: contact@rovelia.io
