Article 1 - Purpose


These Terms and Conditions of Use (hereinafter "TCU") govern access to and use of:
the website Rovelia.io (hereinafter "the Website"),
the Rovelia mobile application (hereinafter "the Application"),
the private community hosted on the Discord platform (hereinafter "the Community").
Any use of the Website, the Application or the Community constitutes full and unreserved acceptance of these TCU.


Article 2 - Conditions of Access


2.1. Mobile Application and Website


Access to the Website and the Application is free of charge and open to any individual aged at least 13 years.
Users aged between 13 and 17 years must have obtained prior authorisation from their legal guardian before registering. By registering, the minor user declares and warrants that they have obtained such authorisation. The Publisher cannot be held liable for any registration carried out without the required parental consent.


2.2. Discord Community (Book Club)


Access to the Discord Community is strictly reserved for individuals who have reached the age of majority (18 years old) and who have full legal capacity.
Any user subscribing to the Community declares and warrants that they have reached the age of majority at the time of registration. Any subscription taken out by a minor is null and void.
Access to the Community is subject to the taking out of a paid subscription, in accordance with the Terms and Conditions of Sale available on the Website.


Article 3 - Rules of Conduct


Users agree to use the services in compliance with all applicable laws and regulations.
The following are strictly prohibited:
hateful, discriminatory, defamatory, sexist, racist or unlawful statements;
harassment, spam, and the distribution of violent, pornographic or unlawful content;
any attempt at fraud, hacking, intrusion or disruption of the services;
the disclosure of other members' personal information without their explicit consent.
Any breach may result in the immediate suspension or deletion of access, without compensation or refund, except where required by mandatory legal provisions, and may, where applicable, result in legal proceedings brought by the Publisher.
The Publisher has sole discretion in assessing the seriousness of any breach and reserves the right to act without prior formal notice in the event of a serious breach.


Article 4 - Intellectual Property


The original content published on the Website and the Application (texts, graphics, layouts, logo, etc.) is the exclusive property of the Publisher and is protected by French intellectual property law.
Book covers and third-party images remain the property of their respective publishers and/or authors. They are used for illustrative purposes, with credits mentioned where required, in accordance with the Credits page accessible on the Website.
Any unauthorised reproduction, representation, modification or exploitation is prohibited and may give rise to legal proceedings for infringement.


Article 5 - Hyperlinks and Affiliate Links


The Website and the Application may contain hyperlinks redirecting to third-party websites.
Some of these links may be affiliate links, meaning that the Publisher may receive a commission on sales made, at no additional cost to the user.
The Publisher exercises no control over these third-party websites and accepts no liability for their content, security, offers or transactions.


Article 6 - Liability


The Publisher endeavours to ensure the proper functioning of the services but cannot be held liable for:
interruptions, outages or errors beyond its control;
indirect damages, data loss or financial loss resulting from use of the services;
content published by users within the Discord Community;
technical failures of the Discord platform or any other third-party service.
Each user is solely responsible for their statements, publications and conduct within the services.


Article 7 - Personal Data and Cookies


Use of the services involves the collection and processing of personal data, including: email address, first name, date of birth, and Discord username where applicable.
Full details regarding the collection, use and protection of personal data are set out in the Privacy Policy, available on the Website.
Cookie consent is collected and managed via the Cookiebot solution, allowing users to accept or refuse cookies.


Article 8 - Amendments to the TCU


The Publisher reserves the right to amend these TCU at any time.
In the event of a substantial amendment, users will be informed by any appropriate means (notification on the Website, the Application, email, or any other communication channel), within a reasonable period prior to the amendments coming into force.
Continued use of the services following publication of the updated TCU constitutes acceptance of the amendments. If you do not accept the amended TCU, you are invited to cease using the services and to cancel your subscription where applicable.


Article 9 - Governing Law and Jurisdiction


Please note that even if you are based in the United States or any other country outside France, these TCU are governed exclusively by French law. By using our services, you acknowledge and accept that French law applies to your use of the Website, the Application and the Community.
In the event of a dispute and after an attempt at amicable resolution, exclusive jurisdiction is attributed to the courts of Paris, France, subject to any mandatory legal provisions applicable to consumers.
